Terms of Use

1. Acceptance of Terms

By accessing or using PokéMarket ("the Platform"), you agree to be bound by these Terms of Use. If you do not agree to these terms, do not use the Platform. PokéMarket is a prediction market platform built on Solana for betting on Pokémon trading card prices.

2. Eligibility

By using PokéMarket, you represent and warrant that:

• •You are at least 18 years of age or the legal age in your jurisdiction
• •You have the legal capacity to enter into binding agreements
• •You are not located in a jurisdiction where prediction markets are prohibited
• •You are not on any sanctions list or restricted from using cryptocurrency services

3. Platform Description

PokéMarket operates a parimutuel prediction market where users can:

• •Bet USDC on whether Pokémon card prices will exceed certain thresholds
• •Participate in markets that resolve based on oracle-provided price data
• •Claim winnings when markets resolve in their favor

• •Finality: All bets are final and cannot be cancelled, modified, or withdrawn once placed.
• •Minimum Bet: The minimum bet amount is $1 USDC.
• •Fees: A 2% fee is charged on winning payouts only.
• •Payouts: Winners receive a proportional share of the total pool based on their stake in the winning side.
• •Resolution: Markets are resolved by Switchboard oracles based on real card price data.

6. Prohibited Activities

You agree not to:

• •Attempt to manipulate market outcomes or oracle data
• •Use bots or automated systems to gain unfair advantages
• •Exploit bugs or vulnerabilities in our smart contracts
• •Use the Platform for money laundering or other illegal activities
• •Interfere with the normal operation of the Platform

7. Intellectual Property

PokéMarket and its original content, features, and functionality are owned by PokéMarket and are protected by international copyright, trademark, and other intellectual property laws. Pokémon and related trademarks are owned by The Pokémon Company. PokéMarket is not affiliated with, endorsed by, or sponsored by The Pokémon Company or Nintendo.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKÉMARKET AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

This includes but is not limited to losses resulting from: (a) your use of or inability to use the Platform; (b) any unauthorized access to or use of our servers or any personal information stored therein; (c) any bugs, viruses, or the like that may be transmitted through the Platform; (d) any errors in or omissions from oracle data.

9. Indemnification

You agree to indemnify and hold harmless PokéMarket and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform or violation of these Terms.

10. Dispute Resolution

Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in class action lawsuits or class-wide arbitration.

11. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

12. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice, for any reason whatsoever, including breach of these Terms. Upon termination, you may still claim any pending winnings from resolved markets.
